Effective 1 July 2025, all registered tax practitioners must comply with Section 45 of the Tax Agent Services (Code of Professional Conduct) Determination 2024. This new obligation requires practitioners to proactively inform clients —both current and prospective — about key aspects of their registration and conduct.

At ASF, we take this responsibility seriously. Here's how we're ensuring full compliance while keeping our clients informed and empowered.

What Section 45 Requires

  • Our registration status with the Tax Practitioners Board (TPB): We are a registered tax agent with the TPB. Verify our credentials via the TPB Public Register.

  • The Code of Professional Conduct that governs our services. 

  • Making a complaint: Lodge complaints directly with the TPB via the TPB Complaints Page.

  • Prescribed Events: We confirm that no prescribed events (e.g., suspension, bankruptcy, convictions) apply to our practice.

  • Our professional indemnity insurance coverage

  • Our commitment to ethical and competent service delivery

These disclosures must be made in a clear, timely, and accessible manner, and must be updated if any of the information changes.

 

How ASF Is Implementing Section 45

  • Updated Engagement Letters: Every new client receives a letter outlining our TPB registration, Code obligations, and complaint procedures.

  • Website Disclosure Page: A new section on our website clearly states our registration details, insurance coverage, and ethical commitments.

  • Staff Training: All team members have undergone training to ensure consistent messaging and compliance.

  • Client Onboarding Checklist: Our onboarding process now includes a compliance step to verify that all Section 45 disclosures have been made.
